No bail for environmentalists

Ramesh Agrawal's lawyers have told Amnesty International that after the application has been rejected, the two human rights defenders will appeal to the Indian Supreme Court for bail release.

Ramesh Agrawal works for the environmental protection organization Jan Chetna, Dr. Harihar Patel is a doctor and practices indigenous healing methods. Both men were arrested on May 28 in Raigarh city, Chhattisgarh state. There they had spoken out against the pollution caused by industrial companies and warned of a possible further threat to the environment from industrial plants whose construction is planned in the central region of Chhattisgarh. Ramesh Agrawal and Dr. Harihar Patel had raised their concerns during consultations called by the authorities because they were required to do so. After his arrest, Ramesh Agrawal was taken to hospital for treatment for his high blood pressure, but was chained to his bed. After three days, the police stopped the cruel, inhuman and degrading treatment due to the protests.

The two environmentalists are leading a campaign to pressure the authorities to disclose information about how the local Adivasi communities will be affected by the proposed projects. Ramesh Agrawal and Dr. Harihar Patel would like to obtain a comprehensive information transfer. Amnesty International believes that her arrest is intended to stop her non-violent campaigning activities. The two environmentalists were charged with "defamation," "disturbing public order," and "creating unrest and panic" at a dutiful public meeting of state authorities held on May 8, 2010 in Tamnar Town .

At the meeting, plans for the expansion of a coal-fired power station of the private company Jindal Steel and Power were discussed. The expansion, so critical voices, will go hand in hand with the expropriation of land that is currently still in the possession of the surrounding village communities. Ramesh Agrawal and Dr. Harihar Patel had opposed the expansion plans and quoted from an official test report, according to which the expansion of the plant had started even before the responsible authorities had given the necessary approval for the expansion. In addition, Ramesh Agrawal obtained a temporary stop on the expansion of the facility from the Ministry of Environment and Forestry. However, after the delays in construction were sued, the authorities arrested the two environmentalists.
